- Locke’s contract is consent to a trustee government for liberty and estate. The Preamble’s justice, liberty, equality, and fraternity are the public terms of that trust.
- Rousseau’s people as sovereign appears in the enacting formula: the people give the Constitution to themselves, not a crown.
- Granville Austin read the Assembly as a seamless web of national unity, democracy, and social revolution. The Preamble is the short text of that bargain.
- Kesavananda Bharati (1973) treated the Preamble as a key to basic structure, so the contract is not a preface that Parliament may empty.
What kind of contract
- It is hypothetical and founding, not a signed parchment of every citizen. Rawls would call it public terms of social cooperation.
- The 42nd Amendment added socialist, secular, and integrity, which amended the stated terms of the bargain after Emergency politics.
- Ambedkar warned that political democracy without social democracy would fail the contract’s equality and fraternity.
- Unlike Hobbes, the Preamble does not authorise an undivided extra-constitutional sword. Limitation is written into the same people-made text.

Making of the Indian Constitution
Constitutional morality is respect for constitutional forms, rights, and limits beyond the will of a passing majority. Ambedkar treated it as necessary because Indian social life still contained caste hierarchy. Part III, judicial review, federalism, and parliamentary procedure are the institutional face of that morality. Kesavananda’s basic structure is a judicial cousin of the same idea. The term is contested when courts apply it, but its political core remains a warning against personal and purely majoritarian rule.

India took parliamentary cabinet government, Westminster procedure, and much 1935 institutional design from Britain. Dicey’s rule of law influenced Article 14, but India wrote rights and judicial review into the text. Federal lists, the Governor, and emergencies also travel from the 1935 Act. Austin’s cornerstone argument treats this as a new nation’s charter, not a colonial statute continued. Parliamentary sovereignty in the British sense was refused.

Austin named social revolution as a strand of the constitutional web beside democracy and unity. Ambedkar drafted justiciable equality, including abolition of untouchability, as the legal engine. The making is an attempt; social facts still lag the text.
