The Preamble of the Constitution affirms the basic features of the Constitution and the promotion of human dignity – Elucidate.

Revision summary

The Preamble names sovereignty, socialism, secularism, democracy, and the republic as the polity’s identity. Justice, liberty, and equality state goals that the basic-structure doctrine protects. Kesavananda used the Preamble as a guide to unamendable essentials. Fraternity expressly assures the dignity of the individual. Dignity then informs equality, freedoms, and Article 21.

The Preamble is the key to the Constitution’s philosophy. Elucidation must show that its words both name the basic structure and commit the Republic to the dignity of the person.

  • Sovereign, socialist, secular, democratic, republic—read with justice, liberty, equality, and fraternity—state the identity that later cases treat as part of the basic structure.
  • Kesavananda Bharati (1973) treated the Preamble as a guide to what Parliament cannot destroy while amending the Constitution.
  • Justice (social, economic, political) and equality of status and opportunity lock in the welfare and non-discrimination core of the text.
  • The 42nd Amendment added socialist and secular, which the Court has read as already implicit in the original scheme.

Promotion of human dignity

  • Liberty of thought, expression, belief, faith, and worship protects the inner person, not only the voter.
  • Fraternity assuring the dignity of the individual and the unity of the nation is an express dignity clause.
  • That line feeds Articles 14, 19, 21 and the idea that development cannot treat people as means.
